Terms of Service
The agreement governing Pal Call use, responsibilities, compliance, fees, service limits, and liability.
Pal Call Terms of Service
Effective date: September 23, 2026
These Terms of Service ("Terms") form a binding agreement between you and Pal Call regarding your use of Pal Call. If you use Pal Call for a company or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.
1. Eligibility and authority
You must be at least 18 years old and legally able to enter a contract. If you create or administer a business account, you represent that you are authorized to connect the phone numbers, provider accounts, users, recordings, and data you place under Pal Call management.
2. Service description
Pal Call provides software for call management and call protection, which may include risk scoring, caller reputation, allow/block lists, attack detection, shared threat intelligence, Voice Challenge, IVR routing, alerts, reporting, integrations, and other features. Feature availability depends on your plan, configuration, provider, provider permissions, carrier behavior, and third-party APIs.
Pal Call is not a telephone carrier, public-safety answering point, emergency communications service, credit bureau, law-enforcement agency, or legal determination service unless expressly stated in a separate written agreement.
3. No guarantee that every harmful call will be stopped
Call-protection systems are probabilistic. No service can guarantee that every spam, robocall, spoofed, abusive, or fraudulent call will be detected or blocked, or that every legitimate call will be allowed. False positives and false negatives can occur. You are responsible for selecting protection modes appropriate for your business and maintaining appropriate allowlists, blocklists, routing, and operational fallback procedures.
4. Caller ID and spoofing
Caller ID can be manipulated. Pal Call risk, reputation, identity, carrier, or verification signals are indicators only and are not proof that the apparent owner of a number placed a call or committed misconduct. You may not publish or use Pal Call risk information to make defamatory statements or unrelated eligibility decisions about an individual.
5. Third-party providers
Pal Call may integrate with RingCentral, Twilio, carriers, payment providers, and other third parties. Your use of those services remains subject to their terms, fees, policies, limits, and availability. Pal Call is not liable for an outage, API change, suspension, permission denial, number-routing change, carrier decision, or other event caused by a third party outside Pal Call's reasonable control.
6. OAuth, tokens, and permissions
When you authorize an integration, you permit Pal Call to use the permissions you approve for the purposes of providing the requested service. You are responsible for ensuring that the connected account and numbers belong to you or that you are authorized to administer them. You may revoke provider access subject to the provider's capabilities, but revocation can disable Pal Call features.
7. Voice Challenge and IVR
If Voice Challenge is enabled, suspicious calls may be routed through an automated prompt that asks the caller to take an action, such as pressing a specified digit. A failed or incomplete challenge may result in rejection, disconnection, voicemail, forwarding, additional screening, or another configured action.
You are responsible for ensuring that your prompt, IVR, routing, and any recording or monitoring practice complies with applicable federal and state law.
8. Outbound calling and U.S. telemarketing compliance
If you use any outbound calling, campaign, prerecorded/artificial voice, automated dialing, marketing, or related feature, you are solely responsible for determining and documenting the lawful basis for every call. This includes compliance, when applicable, with the Telephone Consumer Protection Act (TCPA), FCC rules, the FTC Telemarketing Sales Rule (TSR), the National Do Not Call Registry, state telemarketing laws, calling-time restrictions, caller-identification requirements, consent and revocation rules, opt-out requirements, recordkeeping obligations, and campaign-specific restrictions.
You must obtain and retain legally sufficient consent when required. You may not rely on Pal Call, a purchased lead, or a third party as proof that consent exists. You must honor revocation and do-not-call requests as required by law.
9. Prohibited use
You may not use Pal Call to: violate law; place unlawful robocalls or telemarketing calls; harass, threaten, stalk, defraud, impersonate, or deceive; spoof caller ID with unlawful intent; interfere with emergency communications; attack or overload networks; bypass security controls; access accounts or numbers without authorization; distribute malware; unlawfully record or monitor calls; process regulated data that Pal Call has not agreed in writing to support; or use Pal Call risk information for credit, employment, housing, insurance, or other eligibility decisions governed by laws such as the FCRA.
The Acceptable Use Policy is incorporated into these Terms.
10. Emergency services
Pal Call Shield is not a substitute for 911 or another emergency service. You must not configure Pal Call in a manner that unlawfully blocks, delays, or interferes with emergency communications. You are responsible for maintaining any emergency-calling capabilities required by your carrier, PBX, or applicable law.
11. Account security
You are responsible for maintaining accurate account information, protecting passwords and devices, limiting administrator access, enabling available security controls, and promptly notifying Pal Call of suspected unauthorized access. Actions taken through authenticated accounts may be treated as authorized unless Pal Call has reason to know otherwise.
12. Support and sensitive information
Do not place passwords, full payment-card data, Social Security numbers, medical records, or unnecessary provider secrets in support tickets. Pal Call may redact or remove sensitive information from support content when reasonably necessary for security.
13. Fees, wallet balances, and third-party charges
You agree to pay prices disclosed for your plan or usage. Third-party carrier, number, API, messaging, tax, or telecommunications charges may be separate from Pal Call charges. Unless expressly stated otherwise, wallet credits are not bank deposits, are not interest-bearing, and may be restricted to service use.
Except where law requires otherwise or a written refund policy states otherwise, fees attributable to services already delivered or usage already incurred are non-refundable. Duplicate charges, billing errors, or unused prepaid amounts will be handled under the posted refund policy and applicable law.
14. Taxes
You are responsible for applicable taxes, fees, duties, and governmental charges associated with your purchase or use, except taxes imposed on Pal Call's net income, unless law requires a different allocation.
15. Suspension and termination
Pal Call may suspend or restrict service when reasonably necessary to address nonpayment, abuse, fraud, security threats, unlawful use, excessive technical risk, provider requirements, legal process, or a material breach of these Terms. We may terminate an account for material or repeated violations, subject to applicable law and any separate written agreement.
16. Customer data and licenses
You retain rights in data and content you lawfully provide. You grant Pal Call a limited license to host, process, transmit, transform, and display that content as reasonably necessary to provide, secure, support, and improve the service and to comply with law. You represent that you have the rights necessary to provide the content and instruct Pal Call to process it.
17. Intellectual property
Pal Call's software, Shield engine, interfaces, designs, documentation, trademarks, and related technology are owned by Pal Call or its licensors. Except for the limited right to use the service, no intellectual-property rights are transferred to you. You may not reverse engineer, resell, sublicense, scrape, copy, or create derivative works from protected parts of the service except as permitted by law or written authorization.
18. Feedback
If you voluntarily provide product feedback, you grant Pal Call the right to use it without restriction or compensation, provided Pal Call does not publicly identify you as the source without permission.
19. Beta, test, and experimental features
Features identified as beta, preview, mock, test, experimental, or similar may be incomplete, changed, rate-limited, or discontinued and should not be relied upon for mission-critical operations unless Pal Call expressly states otherwise.
20. Security and service availability
We use reasonable safeguards and aim to provide reliable service, but Pal Call does not guarantee uninterrupted, error-free, or attack-proof operation. Service can be affected by maintenance, provider outages, internet failures, carrier routing, API limits, malicious activity, and events beyond reasonable control.
21. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAL CALL IS PROVIDED "AS IS" AND "AS AVAILABLE." PAL CALL DISCLAIMS IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT A SECURITY SCORE, REPUTATION RESULT, ROUTING ACTION, REPORT, OR THIRD-PARTY INTEGRATION WILL BE COMPLETE OR ERROR-FREE. Some jurisdictions do not allow certain disclaimers, so some of these limitations may not apply to you.
22. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAL CALL AND ITS OWNERS, AFFILIATES, PERSONNEL, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOSS OF GOODWILL, OR LOSS OF DATA ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAL CALL'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO PAL CALL FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. This limitation does not apply where prohibited by law or to liability that cannot lawfully be limited.
23. Indemnification
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Pal Call and its owners, affiliates, personnel, and service providers from third-party claims, liabilities, damages, penalties, costs, and reasonable attorneys' fees arising from your unlawful calls, campaigns, content, numbers, recordings, provider accounts, violation of consent or do-not-call requirements, violation of these Terms or the Acceptable Use Policy, or infringement of another person's rights.
24. Compliance with U.S. sanctions and export controls
You may not use the service in violation of applicable U.S. export-control or sanctions laws. You represent that your use is lawful and that you will not knowingly provide the service to a prohibited person or for a prohibited purpose.
25. Changes to the service or Terms
Pal Call may modify features and may update these Terms. Material changes will be posted with an updated effective date, and we will provide additional notice or seek renewed acceptance when legally appropriate. Continued use after an effective update may constitute acceptance where permitted by law.
26. Electronic communications
You consent to receive agreements, notices, security alerts, billing information, and other service communications electronically. You are responsible for maintaining a valid email address. This does not constitute consent to receive marketing calls or texts where separate consent is required.
27. Informal dispute resolution
Before filing a non-emergency legal claim against Pal Call, you agree to send a written notice describing the dispute to the Contact page / صفحة التواصل and allow 30 days for good-faith resolution, unless applicable law allows immediate relief. Nothing in this section limits rights that cannot legally be waived.
28. Governing law and venue
These Terms are governed by applicable United States federal law and, for state-law matters, the law of the state in which the contracting Pal Call entity is organized / الولاية التي ينظم فيها الكيان المتعاقد, without regard to conflict-of-law principles, to the extent that choice is enforceable. If the state in which the contracting Pal Call entity is organized / الولاية التي ينظم فيها الكيان المتعاقد is not configured in the Legal Information published by Pal Call, governing law and venue will be determined under otherwise applicable law.
29. No waiver; severability; assignment
A failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions remain effective. You may not assign your account or these Terms without Pal Call's written consent, except where law provides otherwise. Pal Call may assign these Terms in connection with a merger, reorganization, financing, or sale of all or substantially all relevant assets.
30. Entire agreement and order of precedence
These Terms, the Privacy Policy, Acceptable Use Policy, Cookie & Tracking Notice, any posted plan or refund terms, and any separately signed agreement constitute the agreement governing the service. If a separately signed agreement conflicts with these online Terms, the signed agreement controls for that conflict.
